Domestic Violence or Domestic Battery charges are generally the result of causing (or attempting to cause) physical (and sometimes emotional and financial) harm to a household member. This could be a spouse, domestic partner or other household members. There are always two sides to a story and it’s important that you have a criminal defense attorney who can fairly represent you.

Domestic Battery Charges in Indiana

Similarly to “Battery” charges, “Domestic Battery” charges are reserved for when battery is committed against a family or household member. (Domestic Battery, IC 35-42-2-1.3)  Other charges, such as, “Criminal Confinement”, “Kidnapping”, “Child Endangerment” and “Rape” often accompany “Domestic Battery” charges.

Domestic Battery Penalties in Indiana

In stark contrast to penalties for “Battery”, “Domestic Battery” penalties are significantly higher starting with a Class A misdemeanor and up to $5,000 fine and 1 year in prison, all the way to a Level 2 Felony with fines of up to $10,000 and up to 30 years in prison.

Domestic Violence Charges in Ohio

“Domestic Violence” charges in Ohio can not only be physical but also emotional and financial. Similarly to Indiana, the charges for “Domestic Violence” in Ohio are specifically reserved for crimes committed against a family or household member. (OH RC 2919.25)

Domestic Violence Penalties in Ohio

Similarly to Indiana, the penalties for Domestic Violence charges are significantly higher than “equivalent” crimes committed against an individual who is not a family or household member. A misdemeanor offense could result in as little as 60 days in jail and a $500 fine up to a 3rd degree felony with sentencing up to 3 years and a $10,000 fine.

Special Considerations for Domestic Violence and Domestic Battery Charges

Victims of domestic violence also have additional remedies and legal protections including Protective Orders, Civil Lawsuits, Custody/Child Support and even Spousal support.
